This Privacy Policy applies to information collected through the Service, including our website, application, APIs, integrations, and customer support channels.

Depending on how you interact with Customily, this Privacy Policy may apply to you in different ways:

Website Visitors
If you visit our website, we collect information such as analytics data, cookies, and any information you voluntarily submit through contact forms, live chat, or other communications.

Merchant Users
If you create or use a Customily account, we collect and process information necessary to provide and improve the Service, including account information, billing information, uploaded content, support communications, and other information related to your use of the Service.

Merchant Customers (Shoppers)
Customily enables merchants to create and sell personalized products. When you purchase or personalize a product from one of our merchants, Customily generally processes your information solely on behalf of that merchant. In these situations, the merchant is responsible for determining how your personal information is collected and used, while Customily acts as a service provider or data processor. If you have questions about how your information is handled or wish to exercise your privacy rights, you should contact the merchant from whom you purchased the product. Where required by applicable law or our contractual obligations, we will assist merchants in responding to such requests.

3. Information We Collect

The information we collect depends on how you interact with our Service. We collect information that you provide directly to us, information collected automatically when you use the Service, and information we receive from third parties.

3.1 Information You Provide

Depending on how you use the Service, you may provide information including:

  • Account information, such as your name, email address, company name, username, and account credentials.
  • Billing and subscription information, including billing address, tax information, and subscription details. Payment card information is processed directly by our payment processors and is not stored by Customily.
  • Content you upload or create, including designs, templates, artwork, images, fonts, personalization assets, print files, and other files or content you choose to store within the Service.
  • Information submitted through forms, surveys, or other communications.
  • Customer support communications, including emails, live chat conversations, support tickets, screenshots, screen recordings, attachments, and any other information you choose to share with us while requesting assistance.
  • Feedback, feature requests, bug reports, and other information you voluntarily provide.

We do not use your content to train our own AI models unless we explicitly notify you and obtain any consent required by applicable law.

5. Personalization Data

Customily enables merchants to create and sell personalized products. When a shopper personalizes a product through a merchant's store, the shopper may provide information such as names, uploaded photos, personalization text, dates, or other content required to customize the product ("Personalization Data").

Customily does not have a direct relationship with shoppers. The personalization experience is provided on behalf of the merchant, through the merchant's storefront or other merchant-configured personalization experiences. We process Personalization Data solely to provide the requested personalization experience and related services. We do not use Personalization Data to contact shoppers directly or for our own marketing purposes.

This includes generating live previews, creating production-ready files, facilitating order fulfillment through connected integrations, providing customer support, and maintaining the security and reliability of the Service.

Unless otherwise required by law or agreed with the merchant, Personalization Data is retained for up to six (6) months after it is received. This retention period allows merchants sufficient time to fulfill orders, address production issues, process replacements or reorders, and provide customer support. After this period, the data is securely deleted or anonymized in accordance with our data retention practices.

If you are purchasing or personalizing a product from one of our merchants and have questions about how your personal information is collected or used, or wish to exercise your privacy rights, you should contact the merchant directly. Where required by applicable law or our contractual obligations, Customily will reasonably assist merchants in responding to such requests.

6. Cookies & Analytics

We use cookies and other technologies on our website and application to operate the Service, remember your preferences, improve your experience, understand how the Service is used, monitor performance, troubleshoot issues, and support our marketing activities.

These technologies may include cookies, pixels, tags, local storage, analytics tools, and session replay technologies.

Chat conversations may be transmitted, recorded, stored, and processed by Customily and our third-party service providers that facilitate customer communications and support. We use these communications to:

As part of providing the Service, Customily generates outputs based on Personalization Data submitted through the merchant's storefront. These outputs, such as live previews, production-ready files, and other assets required to produce personalized products, may be shared with the merchant and, where applicable, with connected print-on-demand or fulfillment providers solely for the purpose of producing and fulfilling the personalized order.

8.4 Legal Requirements

We may disclose information if we believe doing so is necessary to:

  • Comply with applicable laws, regulations, legal processes, or governmental requests.
  • Enforce our Terms of Service or other agreements.
  • Protect the rights, property, or safety of Customily, our users, or others.
  • Detect, prevent, or investigate fraud, security incidents, or other illegal activity.
8.5 Business Transactions

If Customily is involved in a merger, acquisition, financing, asset sale, bankruptcy, or other corporate transaction, information covered by this Privacy Policy may be transferred as part of that transaction, subject to applicable law.

Business customers who require additional contractual commitments regarding international data transfers may request to enter into a Data Processing Agreement (DPA) with Customily.

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including providing the Service, maintaining account history, responding to customer support requests, complying with legal obligations, resolving disputes, enforcing our agreements, and protecting the security and integrity of the Service.

Different types of information may be retained for different periods depending on their purpose and applicable legal or contractual requirements.

When personal information is no longer required for these purposes, we will securely delete, anonymize, or otherwise dispose of it in accordance with our data retention practices, unless a longer retention period is required or permitted by applicable law.

The Service is not intended for children under the age of 13, and we do not knowingly collect personal information directly from children under 13. If we become aware that we have collected personal information directly from a child under 13 without appropriate consent, we will take reasonable steps to delete such information.
